Role Description
The objective of thepliance team is to deliver, coordinate and continuously develop an effectivepliance management framework that provides the tools to enable FNZ to identify, assess, control and monitor conduct and regulatory risk and through that framework manage risk within the appetite of the business, our clients and regulators.
Thepliance Manager works in the second line of defence and brings both experience and knowledge of regulatory requirements in respect of MiFID, AML and GDPR. Their practical experience and achievements in similar roles will demonstrate their ability to provide oversight of the regulatory risk environment and their ability to challenge the business across the core elements of thepliance management framework. While FNZ is technology business, the role requires wider FS industry experience, ideally within a fast-paced regulated environment with exposure to MiFID regulations.
The role will support the implementation and maintenance of thepliance Management Framework to support FNZ's business plan and the regulatory environment it operates in. This includes provision of oversight of the application of regulatorypliance policies and procedures, executing thepliance monitoring plan, monitoring, and reporting onpliance with MiFID, AML, Financial Crime and GDPR regulations.
The duties and responsibilities of this role will include the following:
1. Ensure there are appropriate regulatory controls in place within FNZ (Europe) DAC to establish and maintain FNZ (Europe) DAC'spliance with regulatory requirements including conduct obligations.
2. Ensure that an annual risk-basedpliance assessment and monitoring plan is carried out for FNZ (Europe) DAC.
3. Ensure regulatory reporting to regulatory authorities on behalf of FNZ (Europe) DAC is timely and accurate.
4. Ensurepliance training is provided to FNZ (Europe) DAC employees.
5. Ensure that conflicts of interest have been identified and where possible mitigated and ensure that there is a regular review of conflicts of interest.
6. Report to FNZ (Europe) DAC Head ofpliance onpliance with FNZ (Europe) DAC's regulatory requirements.
Data Protection:
7. Monitorpliance with EU data privacy requirements and GDPR and with the Global Data Privacy Policy and second level data privacy policies, throughpliance Monitoring reviews and high frequency monitoring.
8. Oversee thepletion and maintenance by FNZ (Europe) DAC of Records of Processing, records of personal data breaches, records of data subject rights requests and data privacy impact assessments.
9. Review personal data breaches, assessing reportability of controller breaches by FNZ (Europe) DAC, advising on actions to be taken and assisting in identifying trends.
10. Meet with clients and prospective clients in relation to data privacypliance.
11. Be available to business owners and employees (data subjects) on matters relating to data privacy and data subject rights.
12. Provide management information on data privacypliance for reporting to the Board andernancemittees.
Experience Required
13. In-depth knowledge of the European financial services and regulatory framework MiFID II, GDPR, CBI Regulations.
14. 5-10 years' experience working at a senior level within a regulated environment
15. Working knowledge of operational processes of MiFID or fund administrator firms (, asset servicing, investment operations processes).
16. Excellentmunication, relationship management and influencing skills.
17. Presentation skills and training / coaching experience.
18. Ability to understand and articulate themercial benefits of effectivepliance management.
19. Ability to build and maintain effective internal and external relationships.
20. Ability to analyse, present and report risk management information to senior stakeholders.
