The purpose of the Legal Counsel position is to support and assist the Head of Legal and the legal team as well as other stakeholders (Commercial, Operations, Compliance) in relation to Insurance Law and Regulatory matters primarily for German market, with some assistance on cross border topics for Austria and other European countries.
This position is available on a 100% remote basis in Germany and/or on a hybrid basis with visits to the Dublin office.
Key Responsibilities:

Advise the Company on Legal and Regulatory topics relating to:
Legal and regulatory requirements that the Companies must comply with as insurance product manufacturer of Life and non-Life Insurance business operated in Germany on a Freedom of Services basis.
Legal and regulatory requirements that the Companies must comply with in relation to insurance customer documentation and marketing materials primarily for the German market.
Advise the Company as Insurer on relevant Insurance distribution topics through German and Austrian intermediaries (including trade accessory intermediaries)
Work with the business on Insurance Law and regulatory matters to help to innovate and simplify insurance products and solutions and communications mainly in the German market.
Keeping up to date with and advising on changes in legislation that may impact the Companies mainly in the German and Austrian market.
Conducting legal research as required.
Checking product and other initiatives from a legal view.
Assisting with and managing legal disputes and contentious matters which impact CNPSI either through litigation or mediation mainly in the German market.
Maintaining, managing, and liaising with and controlling external legal counsel relationships.
This role will also include working on cross border insurance topics in other European jurisdictions that CNPSI are present including Austria and others.
Some contract drafting will be required, for example reinsurance agreements, service agreements and distribution agreements.
Reviewing, updating and improving in the development of processes, policies and procedures to mitigate legal risk and/or increase the efficiency of the legal function.
Build collaborative and productive relationships across CNPSI and with key external stakeholders and represent CNPSI at appropriate external forums (e.g. GdV working groups).
Representation of CNPSI before regulatory authorities (e.g. BAFin), if required. Promote the CNPSI values and behaviours within the department and across the business.

Qualifications/Skills required:

Studies in Law in Germany (“1. Staatsexamen”) or Master of Law (“LLM”).
Fully qualified German Lawyer (“Volljurist”) or equivalent. The ideal candidate will have a minimum of 5-6 years’ experience within a busy Legal Team, preferably in a non-life insurance environment.
Admission to the bar is desirable. If desired the candidate will be given the opportunity to be admitted as in-house counsel (“Syndikusanwalt”).
Knowledge of PPI and/or simple protection products is desirable.
Good knowledge of Data Protection Law is desirable.
Strong knowledge of relevant EU and German legislation and regulation relating to Insurance in Germany and Austria including VVG, VersVG, VAG, GewO, BGB, Bafin guidelines etc.
Strong background in Insurance law, legal disputes and claims handling
Extensive legal, insurance industry and/or financial services experience
Good IT literacy.
Excellent communication skills both orally and in writing.
Fluency in both English and German language.
Passionate about putting the customer at the centre of everything, and finding innovative solutions.
Organised individual who can self-manage multiple priorities, routine work and urgent issues as they arise.
Strong sense of risk and control.
Strong cross-functional influencing and team-working skills.
Ability and willingness to travel within the EEA to execute responsibilities.
Confident decision making and good judgment (ability to exercise judgment and communicate the basis of decisions to internal and external stakeholders).
Willingness to view challenges from a commercial risk-based perspective and propose suitably balanced solutions, while approaching with discretion and integrity.
